Refugee Claim Credibility Findings Upheld in Kenya Case
The Federal Court has dismissed a Kenyan citizen’s challenge to a Refugee Appeal Division decision rejecting her protection claim. In Macharia v. Canada (Citizenship and Immigration), 2026 FC 1270, the Court upheld the RAD’s refugee claim credibility findings, its treatment of proposed new evidence and its decision not to hold an oral hearing.
Merida IFA Upheld in Mexican Asylum Claim
The Federal Court has upheld a Refugee Appeal Division finding that Merida was a viable internal flight alternative (IFA) for a Mexican claimant who feared the Jalisco New Generation Cartel. In Sandi v. Canada (Citizenship and Immigration), 2026 FC 1254, the Court dismissed the application for judicial review on October 9, 2026.
Consultant Conduct Challenge Fails in IFA Appeal
The Federal Court dismissed an IFA appeal on October 9, 2026, finding that the applicant had not shown a reasonable probability that different submissions by his former immigration consultant would have changed the Refugee Appeal Division’s result.
Refugee Cessation Upheld Over Re-availment
The Federal Court has dismissed a Pakistani citizen’s challenge to the cessation of her refugee protection, finding the Refugee Protection Division’s refugee re-availment analysis was reasonable and procedurally fair. The Court upheld the RPD’s findings arising from the applicant’s renewed Pakistani passport and three trips to Pakistan between 2015 and 2017.
PRRA Refusal Over Same-Sex Marriage Evidence Sent Back
The Federal Court has ordered a new determination after granting judicial review of a PRRA refusal over same-sex marriage evidence. In Kayaga v. Canada (Citizenship and Immigration), 2026 FC 1248, Justice A. Grant found the officer’s treatment of new evidence was not coherent or transparent.
Ontario REDI Initiative Launches New 2026 Round
Ontario has launched a new round of its Regional Economic Development through Immigration (REDI) initiative, which will run until the end of 2027. The REDI initiative will allocate OINP nomination spaces to selected communities, including Greater Sudbury/Grand Sudbury and the Rainy River District.

The Federal Court dismissed a Mexican mother’s application for judicial review after finding it was reasonable for the Refugee Appeal Division to uphold Merida, Yucatan, as a viable internal flight alternative (IFA) for her and her five daughters. The decision, released October 8, 2026, left the refusal of their refugee protection claims in place.
