IRPA Record Disclosure, Zaitsev v. Canada, 2026 FC 1182

In IRPA Record Disclosure, the Federal Court held that the Minister cannot withdraw information from a certified tribunal record after the Court has ordered it disclosed under section 87 of the Immigration and Refugee Protection Act in a certiorari application. Justice Turley directed the Minister to file an amended redacted record within 30 days so the underlying judicial review can proceed on its merits.

IFA, Martinez Mendez c. Canada, 2026 CF 1180

The Federal Court dismissed a Chilean family’s application for judicial review of a Refugee Appeal Division decision that found an internal flight alternative (IFA) was available in Chile. The Court held that the applicants’ medical, psychological and interpretation arguments were new issues that had not been raised before the Refugee Appeal Division.
