IRCC has published an Instrument of Designation and Delegation that sets out authorities within its mandate and identifies the officers and other persons who may exercise them under the Immigration and Refugee Protection Act.
What the instrument covers
The instrument delegates most powers vested in the CIC Minister under the Immigration and Refugee Protection Act in relation to applying the law. It also designates officers who may carry out authorities vested in them by the Act and describes the duties and powers they may exercise.
While many authorities under the Act are assigned to departmental officers, some duties and powers may be carried out by people outside the department, including locally engaged personnel working overseas, Canada Border Services Agency officers and RCMP officers. The instrument identifies authorities delegated to those persons.
Effective date and scope
The available Instrument of Designation and Delegation is effective July 7, 2026.
It contains only authorities within CIC's mandate. Authorities under the Immigration and Refugee Protection Act that are under the mandate of the Minister of Public Safety and Emergency Preparedness are listed in a separate instrument.
