IRB Proceedings and Appeals Canada: RPD, RAD, ID and IAD

The Immigration and Refugee Board is an independent administrative tribunal, not the Federal Court. Its four divisions decide different matters. This guide explains where a case belongs, selected appeal deadlines, limits on appeal rights and the distinction between tribunal proceedings and court review.

1. The IRB Is a Tribunal, Not a Court

The IRB makes administrative decisions in immigration and refugee matters. A member decides a tribunal case under the relevant legislation and division rules. The Federal Court may review a reviewable IRB matter through a separate legal process.

Start with the Federal Court immigration guide. Identify which division acted, what decision was made and which person has the proposed appeal right. Do not treat 'immigration appeal' as one procedure available to everyone.

2. The Four Divisions Compared

DivisionMain role
Refugee Protection Division (RPD)Decides refugee protection claims and specified related proceedings
Refugee Appeal Division (RAD)Decides eligible appeals of RPD decisions
Immigration Division (ID)Conducts admissibility hearings and detention reviews
Immigration Appeal Division (IAD)Decides specified immigration appeals, including eligible sponsorship, removal and residency cases

Each has its own rules, forms and evidence requirements. A document filed in one process is not automatically a properly filed appeal in another. Use the registry and instructions for the correct division.

3. RPD Hearings and Preparation

A refugee claim is a protection assessment, not an alternative response to an ordinary visa refusal. Prepare the claim narrative, relevant country and personal evidence, identities and required disclosures according to the applicable process.

Understand the hearing notice, interpreter arrangements and how to submit documents. Correct errors transparently and preserve previous statements so discrepancies can be addressed accurately. A designated representative for a child or vulnerable person performs a different role from legal counsel.

If a negative decision arrives, obtain the reasons and assess whether RAD rights exist before selecting a remedy.

4. RAD Appeals and Current Filing Windows

Not every RPD decision is appealable to the RAD. Section 110 contains exceptions; determine eligibility from the actual decision and circumstances rather than simply the fact that the claim was refused.

The current appellant's guide gives 15 days after receipt of written RPD reasons to file the notice of appeal and 45 days to file the appellant's record. Confirm service and receipt requirements, extension procedures and the governing instructions.

RAD proceedings usually rely heavily on written materials; a hearing is not automatic. New evidence has its own admissibility conditions. Do not assume every later document can be added without addressing those conditions.

5. IAD Sponsorship and Other Appeals

Section 63 identifies specified appeal rights, including eligible family-class sponsorship refusals, certain removal orders and overseas residency-obligation decisions. The appellant and legal basis differ by category.

For an eligible sponsorship appeal, the sponsor, not the sponsored family member, files the appeal. Current IRB instructions require receipt of the notice and required documents within 30 days of the refusal decision being received. This is not a general appeal form for visitor, study or work permit refusals.

Other IAD categories have their own trigger and deadline. Do not reuse the sponsorship window without checking the actual category. Alternative dispute resolution or a hearing may be involved according to the process.

6. Appeal Bars and Jurisdiction

An apparent appeal right must be read with statutory limits. Section 64 restricts specified inadmissibility appeals and contains a particular family-class misrepresentation rule. The nature of serious criminality also matters to the restriction.

The spouse, common-law partner or child exception to the misrepresentation sponsorship restriction is not a general exception to every other appeal bar. Membership in the relevant class and tribunal jurisdiction may also require examination.

Use the inadmissibility guide and misrepresentation guide to identify the issue, then obtain an assessment of the actual appeal right.

7. Admissibility Hearings and Detention Reviews

The ID can assess an allegation of inadmissibility and separately reviews reasons for immigration detention. A detention review is not a refugee appeal or a hearing that necessarily resolves the underlying PR application.

Current guidance describes an initial review within 48 hours or as soon as possible afterward, a subsequent seven-day review and continuing 30-day reviews where detention continues. Prepare the information relevant to release, conditions and any proposed alternative to detention.

Detention requires urgent access to appropriate counsel. Keep the notice, alleged grounds and proposed release evidence available. Do not confuse a release decision with approval of immigration status.

8. After an IRB Decision

Check the decision, reasons, applicable appeal and any enforcement implications promptly. Judicial review is not a new tribunal hearing. Applicable statutory appeal rights generally need to be exhausted before IRPA court review.

Court deadlines and removal protection require separate assessment. A tribunal record request or administrative letter does not preserve a court deadline. IRB representation authorization also does not automatically authorize Federal Court representation.

Before a professional assessment, organize the notice, reasons, hearing record where available, filed documents and delivery history. Identify the exact order being challenged rather than only a portal status.

9. IRB FAQ

Are IRB divisions courts?

No. They are divisions of an administrative tribunal.

Can the IAD hear my visitor visa refusal?

The sponsorship appeal process is not available for ordinary temporary visa refusals.

Does every RPD refusal have a RAD appeal?

No. Statutory eligibility and exceptions must be checked.

What are the current RAD windows?

The official guide states 15 days for notice and 45 days for the record after written reasons are received.

Does release from detention give me PR?

No. Detention and substantive immigration status are different issues.

Can my tribunal consultant represent me in Federal Court?

Not merely by being a consultant. Court representation has separate lawyer requirements.
