Permanent resident (PR) applicants in Canada [R207 – A70]

IRCC instructions state that foreign nationals who meet the requirements of section R207 under their respective class may be issued an unrestricted open work permit.

Who may be covered by administrative code A70

Section 207 of the Immigration and Refugee Protection Regulations applies to applicants determined eligible as members of certain in-Canada permanent residence classes. This includes protected persons and family members, whether or not they have applied for permanent resident status.

  • Persons with protected status, such as Convention refugees and successful pre-removal risk assessment applicants
  • Permanent resident applicants approved on humanitarian and compassionate grounds, on the Minister’s own initiative, or for public policy considerations
  • In-Canada family members of the above

Open work permits under R207

An unrestricted open work permit may be issued to a foreign national who has met the requirements of section R207 under their respective class.

Applicants issued a work permit under paragraph R207(c) or (d) do not become temporary residents solely because they were issued that work permit.

Instructions apply to IRCC employees

These instructions are for IRCC employees. They do not apply to border services officers because applicants in Canada cannot submit their applications at a port of entry.
